Terms of Use
Please read these Terms of Use ("Terms") carefully before using Habit Tracker ("the App") developed by qbito ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years old and agree to comply with and be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes on devices you own or control in accordance with these Terms.
You may not:
- Copy, modify, or distribute the App or any portion of it
- Reverse-engineer, decompile, or disassemble the App
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices or labels on the App
3. User Content
All habit data, notes, and personal information you enter into the App is stored locally on your device and remains your property. We do not access, collect, or have any rights to your content.
4. Intellectual Property
The App and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of qbito. The App is protected by copyright, trademark, and other laws.
5. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will function without interruption or be error-free, that defects will be corrected, or that the App or the server that makes it available are free from viruses or other harmful components.
6. Limitation of Liability
To the maximum extent permitted by applicable law, qbito shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the App.
7. App Store Terms
Your use of the App downloaded from the Apple App Store is also subject to Apple's Standard EULA. Your use of the App downloaded from Google Play is subject to Google's Terms of Service.
8. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms. Upon termination, your right to use the App will cease immediately.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will indicate the date of the latest revision at the top of this page. Your continued use of the App constitutes acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
